| Shipping Options Several shipping options are available and depend on
the composition of the order, its final destination, and any special customer
requirements. Customers may elect to utilize the Blackpointe Guaranteed Freight Price
Program which provides a fixed freight cost at the time of order placement. Freight
charges are predetermined and prepaid by Blackpointe and are added to the invoice at the
time of shipment. If the customer does not elect the Guaranteed Freight Price Program,
then Blackpointe will ship by what is determined to be the most reasonable way. The
shipping cost will be calculated and added to the invoice. If the customer prefers to
designate a carrier, then a 10% surcharge will be added to the freight invoice.
Air freight and other special delivery
requirements will be quoted and invoiced separately. Prices do not include inside
delivery, installation or sales tax.
Shipping Policies
Risk of loss of merchandise passes to the
Buyer upon acceptance by the carrier. All shipments should be carefully inspected by the
Buyer.
In the event of freight damage, the
consignee must make a notation on the carrier receipt, and request the delivering driver's
signature. The Buyer must also notify the carrier of the need for an inspection, and then
file a freight claim. All cartons must be opened and inspected immediately, and if
concealed damage is present, the carrier must be notified within 15 days. An immediate
inspection of both the damaged goods and the packaging material must be requested. The
Buyer has the sole obligation of filing claim with the carrier.

causes beyond Blackpointe's reasonable control to obtain necessary labor, manufacturing
