| Statement of Policy GAF Materials Corporation (GAF MC) manufactures and sells roofing materials. It does not practice architecture or engineering. The roofing systems included in this manual will, we believe, result in satisfactory installations when properly applied. Under no circumstances shall GAF MC have any liability for expenses arising out of or associated with the preexisting presence of asbestos-containing materials or any other allegedly hazardous substance or material upon the roof to which the new GAF MC roofing system is being applied. As part of our continuing efforts to improve our products, GAF MC periodically makes modifications to its product and application specifications. GAF MC reserves the right to modify the physical properties and characteristics of its products and application specifications without prior notice. Please contact your nearest GAF MC Sales Office or Technical Services Office with any specific concerns. GAF MC will not write any letters regarding the installation or application of a roofing system that is not covered under our Liberty Guarantee program or regarding information that is published in the GAFGLAS or RUBEROID Application and Specifications Manual or other GAF MC product literature. Unless otherwise informed in writing by a GAF MC Technical Services Manager, only the materials and procedures referenced in this Manual are to be employed in the application of GAFGLAS or RUBEROID Roof systems, including flashing details. The use or misuse of any materials and methods not approved by GAF MC is in no way the responsibility of GAF MC. |
| Warranty and Limitations of
Liability GAF Materials Corporation ("SELLER") warrants that, at the time of delivery, the material delivered shall conform to SELLER'S specifications therefor free and clear of all liens and encumbrances. SELLER DOES NOT MAKE, AND IS NOT TO BE HELD LIABLE FOR, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE OR FOR ANY OTHER WARRANTY OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, EXCEPT AS SET FORTH IN THE PRECEDING SENTENCE. If any material fails to conform to the foregoing warranty, SELLER shall replace such nonconforming material, provided that such material has been handled and installed in accordance with SELLER'S published handling procedures and installation specifications. This warranty does not apply to, and SELLER shall not be liable for, labor costs or any other damages resulting from improper or faulty installation of material or resulting from failure of the material itself. No claims of any kind whatsoever, with respect to material delivered or for failure to deliver any material, regardless of the theory on which a claim may be made including, without limitation, negligence, contract, breach of warranty, strict liability in tort, misrepresentation, or otherwise, shall be greater in amount than the purchase price of the material in respect of which damages are claimed. In no event shall SELLER be liable for: incidental, consequential, special, indirect, or punitive damages. Failure of buyer to give written notice of claim within sixty (60) days after delivery of material shall constitute a waiver by buyer of all claims with respect to such material. |
