Guarantee Terms and Conditions

The JM Guarantees only guarantee to maintain the roofing system in a watertight condition for the term of the Guarantee. See a specimen copy of the Guarantee certificate for more details.

Any changes to the conditions and terms of the JM Guarantees must be approved, in writing, by the Manager, Marketing & Technical Services, located at the JM International, Inc. headquarters in Denver, CO, or by his authorized delegate.

To qualify for a JM Guarantee, all appropriate JM roofing specifications must be followed. Unless otherwise stated, the specification must be approved for the geographical region in which it is installed. All deviations MUST be approved prior to installation by the Manager, Marketing & Technical Services, or his authorized delegate.

For guaranteed recover roofs, contact the Technical Service Staff for approval of the construction as a base for the new roof.

JM Guarantees may only be issued when the roofing system is installed to the satisfaction of JM, by an Approved Roofing Contractor, approved to apply the subject roofing system, in accordance with the appropriate JM specification(s). To qualify for a built-up or modified bitumen system Guarantee, the system must consist of JM materials. All components supplied by JM are covered  under the Guarantee, including membrane, insulation, flashing and accessories.

The roofing contractor must indicate, at the time of application for the Guarantee, the type of Guarantee required. JM will not issue any Guarantee other than the type(s) being issued at that time. Roofing contractors should check the project specifications carefully for guarantee requirements before bidding any project. Guarantees will not be considered unless the notification of award of contract (Form B) is received by JM at least 14 days prior to the start of roof application and is accompanied by a deposit of fifty percent (50%) of the Guarantee charge (100% for minimum charge Guarantees). The second half (50%) of the Guarantee charge is payable with the Completion Notice (Form D). If JM refuses to issue the Guarantee for any reason, the Guarantee charge will be refunded, less an administrative and service charge. Re-issuance of a Guarantee certificate shall carry a $100.00 charge.

On metal decks and nailable decks (where a base felt is not required), the first layer of roof insulation must be mechanically attached. The second and subsequent layers, if used, should be set in a full mopping of hot asphalt with all joints staggered.

When more than one specification is applied on the same building, the Guarantee(s) appropriate to each specification, or group of similar specifications will be issued.

JM reserves the right to make reasonable charges, in addition to the regular Guarantee charge, for inspection service when the project location is remote and where unusual expense is incurred in making the required inspections. No Guarantee will be issued outside the continental United States. Guarantee charges are subject to change without notice.

Except in unusual circumstances, to be approved at the sole discretion of JM, if the Guarantee request is cancelled once the inspection procedure has been initiated, JM will retain the fifty percent (50%) deposit as reimbursement for administrative expenses incurred. For any questions about approved substrates, or any other questions regarding Guarantees and systems, contact the JM Technical Service Specialist at the offices listed in Section 13, References.

To determine the total Guarantee charge, total the squares of roof and multiply by the applicable charge. If the resultant total is less than the minimum, then the minimum charge will apply. The maximum JM liability is determined by multiplying the number of squares by the per square penal sum. In the case of roofs where the minimum payment was made, the JM liability is given in the table on the following page.

Guarantees are solely for the benefit of the identified building owner and will be transferred by JM, at its sole discretion, only after conducting an inspection, accepting the roof for transfer, and receiving payment of a $500.00 transfer fee, delivered to JM no later than 30 days after building ownership transfer. If, upon inspection, JM representatives find deficiencies in the roofing system, the owner will have 30 days to correct the deficiencies to JM’s specifications for the building to be eligible for Guarantee transfer.
