TWENTY YEAR LIMITED WARRANTY
- NON-PRORATED -
In this Warranty, the following terms shall have the following meanings:
"Customer" shall mean the purchaser of the Windows from Fabricator;
"the Extrusions" shall mean the rigid vinyl extrusions manufactured and sold by King Extrusions Limited
("King") to Fabricator, but excluding extrusions which are brown or any variation thereof in color;
"Fabricator" shall mean the purchaser of the Extrusions purchased for the purpose of fabricating
windows therewith (the "Windows).
King warrants that for a period of twenty (20) years from date of purchase, the Extrusions, when fabricated
into vinyl windows in accordance with King's recommendations and specifications, if any, and industry
standards, will not rot, rust, crack, warp, pit, corrode, peel, blister or suffer non-uniform fading discoloration;
Provided that non-uniform Fading discoloration resulting from unequal exposure of surfaces to the sun and
elements is not covered by this warranty.
This warranty covers only manufacturing defects in material and workmanship of King and does not include
defects or damages attributable to, or arising or resulting from the fabrication of the Extrusions into Windows
or the installation thereof into structures or effects or damages caused by accident, fire, flood, abuse
improper maintenance, harmful fumes chemicals, building heat, excessive temperature exposure, color
change arising due to normal weathering, oxidation, extremes of weather and atmospheric conditions and
other like circumstances and causes beyond King's control and unrelated to the manufacturing process. This
warranty does not apply if the Extrusions are painted or coated with any substance or used with windows
which are installed other than on a vertical plane.
This warranty shall be for the exclusive benefit of Fabricator and is void if (I) Fabricator does not warrant the
Windows to Customer for a period of time equal to or exceeding that provided for by this warranty, or (ii)
Fabricator's warranty is not in substance equivalent to and consistent with this warranty. The warranty granted
by Fabricator to Customer shall be the sole responsibility of Fabricator.
Any claim under this warranty is expressly limited, at the option of King' to, (I) the return of the original
purchase price paid for the defective Extrusions, or (ii) the replacement of the defective extrusions and does
not extend to labor costs. King shall not be responsible for any costs incurred in removal of the extrusions or
in respect of other parts or components of the Window.
This warranty is given in lieu of all other warranties either expressed or implied, including warranties of
merchantability and fitness for a particular purpose and sets forth the only warranty for the Extrusions. Neither
King, nor any representative of King, expresses any other warranties with respect to the Extrusions. In no
event shall King be liable for incidental special or consequential damages with respect to the Extrusions or
the Windows. Some States and Provinces do not allow the exclusion or limitation of incidental or
consequential damages so the above limitation or exclusion may not apply.
Any claim under this warranty must be submitted in writing by Fabricator to King promptly after discovery of
the defect claimed, describing with reasonable specificity such defect. King shall be entitled to require
delivery of whatever proof it requires to evaluate the validity of the claim. If King determines the claim is valid,
King agrees, at its option, to either (I) return the original purchase price paid for the defective Extrusion or (ii)
replace the defective Extrusions, which, in either event, are shipped to King, transportation prepaid. The
original warranty period shall not be extended by any replacement, but the remaining warranty time period
shall continue in effect and be applicable under the terms and conditions of this warranty to the replaced
Extrusions.
King reserves the right to discontinue or change extrusions. If the Extrusions have been discontinued or are
not available, King reserves the right to substitute extrusions of equal quality as may be compatible provided
in the event no compatible product is at that time manufactured by King, it shall not be required to create new
dies for the purposes hereof and this warranty shall be of no force or effect.
