CONDITIONS OF SALE |

All orders are subject to our
standard terms and conditions of sale as listed herein and if accepted by us will be
subject to contingencies of material shortages, fire, embargoes, governmental rules or
regulations, delays in transportation, or other causes beyond our control. |
| 2. |
All prices are F.O.B. shipping
point with full freight for customer's account. For orders of less than 2,000 pounds,
there will be a $100.00 handling charge added to each order. |
| 3. |
All orders will be invoiced at
prices prevailing on date of shipment. |
| 4. |
All shipments and deliveries are
subject to the approval of our credit department. Payment in advance or C.O.D. may be
requested if the financial condition of the buyer does not meet our credit standards. |
| 5. |
Terms: 2% cash discount will be
allowed if payment is made on or before the tenth day of the month following shipment. Net
amount of invoice due to last day of the month following shipment. Payment for materials
shall be made in full by the buyer before title passes to the buyer. Cash discount will
not be allowed on C.O.D. or cash-in-advance sales due to our extra handling cost. |

Delivery of material to common
carrier or to our customer's truck shall constitute delivery to the buyer and thereafter
shall be at the buyer's risk. |
| 7. |
Seller shall not be responsible
for any consequential damages arising from use of improper, damaged, or defective
materials. |
| 8. |
Interest shall be charged in a sum
equal to 18% per annum or 1-1/2% per month on all past due account. |
| 9. |
Seller shall be entitled to
reasonable attorney fees in the event legal proceedings are necessary to collect any
amounts due and unpaid. |
| 10 |
Cutting charges for lengths under
5 feet: $.25 per piece plus charge for actual footage cut off. Minimum charge:
$25.00 per order. |
RETURNED MATERIAL POLICY |
11. |
Material
returned by buyer must be freight prepaid and will not be accepted unless permission to
return this material has been granted in advance by seller. A 20% restocking charge will
apply to all returned materials. Any special ordered studs of less than 10' in length or
any nonstandard items, such as special buy our products, are not returnable. |
| SET UP CHARGE POLICIES |
| 1. |
All heavy duty joist and track
under 1,000 feet is subject to a $75.00 set up charge. (EJ,MJ,WJ,DT, & 12 Gauge etc.) |
| 2. |
Standard flange 1" (SS) and
(WFS) structural less than 1,000 feet will have a $50.00 set up charge. |
| 3. |
All structural orders under 1,000
feet that require a special set up, are subject to a $50.00 set up charge. |
